What should I do to a Client who wastes my time and out and out LIES to me?


 

INTRODUCTION

If you misrepresent your case, saying you make less income or have a charge in another state, you have cost me time and money, but more importantly, you have taken my time away from others. I will bill you $1001 for my time in the future. I may not collect, but I can always have you arrested for the Texas charge of Misdemeanor A or Ma Theft of Service. But, should I?

 

CASE STUDY

I had a guy (let's call him DMW) tell me today he didn't have a conviction and was given probation, and he guessed the charge dropped off his Arkansas record. But he didn't want to call the county and get the records.

That, to me, was a red flag. I have never had a client who successfully finished probation with the charge dropped be reluctant to obtain the court paperwork.

DMW e even gave me a phony case number, but I found the felony conviction. 

In addition, I found out DMW might have been reluctant to call the courthouse: he was due today in Arkansas on 2 more felony charges, including felon with a firearm and receiving stolen property (the firearm).

Is this the cost of doing business, or do I have DMW arrested for Texas Ma Theft of Service?

Do the timelines for Apartment acceptance begin "when I caught the charge" or when?

 


The timeframe of “Charge from Dates” to “Acceptance Dates” for apartments varies greatly, making it a complex and challenging task.

  • Some only accept misdemeanors after 5 to 7 years from the conviction date or discharge date.
  • A few companies will never accept an assault misdemeanor conviction.
  • Some accept misdemeanors from the conviction date plus 5 to 7 years.
  • Deferred adjudications are usually not accepted until finished with probation or 5 years from the end of probation. And some—not at all—look at it as a lifetime decline.
  • Felonies depend on the charge (the more serious the charge after parole or probation, depending on whether it was a state charge or a federal charge).
    • DWI can be immediate, lasting 2 years, 5 years, 7 years, 10 years, or not at all.
    • Simple possession is usually 5 years, 7 years, or 10 years from conviction.
    • Manufacturing or delivery is usually 10 years after Parole ends.
    • Financial crimes (credit card abuse, hot checks, etc.) usually last 5-7 years from conviction.
    • Robbery and burglary are usually 7 years from conviction, but a few places only consider these charges for 7 years after parole ends.
    • Serious violent crimes (assault, aggravated charges, M/D, kidnapping, and arson) usually occur 10 years after parole ends. Intoxication assault is a bit different.
    • Firearm and weapon felonies are 10 years after parole.
    • Murder 1 and sex offender crimes—almost never, and the ones that will—won't pay a commission, and I can’t work for free, so I don’t take on these cases.

If you aren’t confused now, let me add one thing.

These policies change often. I called on Monday, and the criteria looked good, but on Tuesday, the criteria changed to not allowing my client to be accepted. When complexes are sold, as they often are, policies change. Don’t think I can give you a list today and it will be good in 6 months; it probably won’t. The best way is to always get involved.

Just a short description of how I work: I have 2 rules and 2 practices.

  • I have to trust you, and I will treat you with kindness. In return, I expect both from you.
  • If you don’t put my name down at the apartments and email me when you are accepted, I will never work with you again. I consider it stealing from me and my family. I expect you to live up to the commitment you made when you filled out the finance form.
  • If I set up a coaching call with you for a certain time, I will try two additional times, and then you must set up a new time. This coaching accounts for my great success in helping people be accepted at the apartment I refer you to and will give you key strategies on how to present your "blemish." Keep in mind that everything is above board and above approach.
  • If you aren’t accepted because of my work and not because of low credit, income different than you listed on the form, or charges in another state or country, I will give you a larger rebate to make up for it.

Will apartments "see" my Deferred Felony after I successfully complete probation?




Yes, and most have rules that don't allow them.

"But, John the DA told me that it would disappear from my record". I can tell you, the charge will still appear in police records and on many public record databases. 

The criminal check companies the apartments use tend to locate the arrest and where you plead guilty to start the deferred adjudication. The Texas Apartment Association (TAA) standard application asks you to detail arrests. If you aren't truthful, you will lose your application and administration fees. I always tell my clients to be truthful. I also advise my clients WHAT TO SAY and WHAT NOT TO SAY.
